The Washington Post reported 45 minutes ago that the Trump administration had decided to NOT appeal the Immigration Ban restraining order to the Supreme Court. It was breaking news. And it was big!
Just now, The Post is reporting White House chief of staff Reince Priebus said the White House is “reviewing all of our options in the court system,” including possibly going to the Supreme Court.
Obviously, the White House is having difficulty sending a clear, unified message to the American people.
Background on the story...
Late yesterday, the US Court of Appeals, 9th District ruled against Trump's appeal to have his immigration ban reinstated.
A week ago, Seattle judge James Robart issued a nationwide restraining order on the Immigration Ban, freezing it's continued implementation.
At some point Trump and his administration will decide how to proceed. As it stands now, they may appeal the 9th Circuit Court's ruling to the Supreme Court. They may rewrite the ban so that it complies with the US Constitution. They may fight the issue in lower courts.
Two things are likely no matter what they do. One: It'll probably be very difficult to get the original ban or any similar ones reinstated (that according to the Washington Post) and Two: It's probably going to be a very rocky road (that according to Trump's brief history in the White House).
